Acquitted of DUI following Jury Trial

Dillon's client was accused of driving a vehicle under the influence of narcotics. The evidence showed that the client performed well on his field sobriety tests, and the blood toxicology raised a genuine question as to whether the client was legally impaired. After the State refused to reduce the charge, the client decided to have a jury trial. Following a two-day jury trial, a jury found the client not guilty on all counts. 

Client Acquitted of Aggravated Vehicular Homicide By Intoxication Following Jury Trial

Dillon’s client was charged with Aggravated Vehicular Homicide By Intoxication, a Class A Felony. A Class A Felony in Tennessee carries a sentence of 15-60 years in prison. The State alleged that the client caused a fatal accident as a result of driving while intoxicated. After the State declined to extend a reasonable offer, Dillon and his client proceeded to a jury trial. As a result of Dillon’s zealous advocacy, a jury acquitted his client of Aggravated Vehicular Homicide By Intoxication. The client was only convicted of significantly lesser offenses, which saved Dillon’s client decades of potential prison time. 

DUI with .12 BAC reduced to Reckless Driving with Judicial Diversion 

Dillon’s client was charged with a DUI following a traffic stop. The client admitted to police that they had been recently drinking and a blood sample showed a BAC of .12. Dillon reviewed the police body camera footage and cruiser footage from the client’s stop and arrest. After identifying and informing the State of legal issues arising from the traffic stop, the State agreed to reduce the charge to Reckless Driving with a judicial diversion. With this outcome, the client’s charge was dismissed after 6 months of probation and the charge was then expunged. 

DUI with wreck reduced to Reckless Driving with Judicial Diversion

Dillon's client was charged with a DUI after following a vehicle wreck. Through case investigation and review of the police body camera footage, Dillon was able to show the State that the wreck was not caused by alcohol intoxication. The State moved to reduce the DUI to a Reckless Driving. The client was able to use a judicial diversion, which allowed for the Reckless Driving to be dismissed after 6 months. Following the dismissal, the client was able to expunge the case from their record. 

DUI reduced to Reckless Driving after showing lawful prescription use

Dillon's client was charged with a DUI following a traffic stop and a blood draw. The client's blood contained concentrations of a controlled substance. However, the State did not realize that the client had a valid prescription for the controlled substance present in their blood. Under Tennessee law, a person can still be charged with a DUI for a drug even if they are prescribed it. However, through research, consultations with experts, and acquiring the necessary medical documentation, Dillon was able to show the State that the concentration of the medication in the client's blood was not an amount that would cause impairment. The State agreed to reduce the DUI to a reckless driving. 

DUI with wreck and alleged narcotics in blood reduced to reckless driving with judicial diversion after jury trial

Dillon's client was charged with a DUI following a motor vehicle accident. After the accident, a blood draw was performed, and the State alleged that the client's blood toxicology contained a high concentration of narcotics. Following a two-day jury trial, the jury was hung, and a mistrial was declared. After the mistrial, the State agreed to reduce the DUI to a Reckless Driving with a judicial diversion.
